The Federal High Court has adjourned indefinitely the trial of the leader of the Indigenous People of Biafra, (IPOB) Nnamdi Kanu, following his objection to Justice Binta Nyako presiding over his case.
In September 2024, Kanu had requested Justice Nyako to recuse herself from the matter. At the hearing on Monday, February 10, Justice Nyako informed the court that the Chief Judge had not accepted the recusal request and had returned the case to her court. She directed the defence team to submit a formal written application to the Chief Judge of the Federal High Court and serve it to the prosecution if they wished to pursue the recusal.
The prosecution counsel, Adegboyega Awomolo, SAN, indicated their readiness to proceed with the case, noting that witnesses were prepared to testify. However, Kanu’s counsel, Alloy Ejimakor, reminded the court of a pending order that remained in effect.
At this point, Kanu addressed the court directly, challenging its jurisdiction to hear his case and expressing dissatisfaction with what he described as the court’s bias. As Kanu continued to voice his concerns, Justice Nyako adjourned the matter sine die (without setting a future date).
