The application which was filed on September 3, 2025, by Kanu Agabi (SAN), lead counsel to the IPOB leader, came up this Thursday before Justice Musa Liman, one of the two vacation judges handling cases while judges of the Federal High Court are on their annual vacation.

During the hearing, Uchenna Njoku (SAN), informed the court that they had already submitted all medical records, including a 14-page affidavit deposed to by Emmanuel Kanu, the defendant’s younger brother.

Justice Liman noted that he would have preferred the applicants to bring the matter before the substantive judge handling the main case.

“The judges’ vacation is almost over. By next Wednesday, courts will resume fully. Why not take this matter before the substantive judge?” Justice Liman asked.

In response, Njoku stated that the matter was very urgent. He clarified that the defendant was not asking for release or bail. Rather, the prayer before the court was for the DSS to transfer Kanu to a proper hospital where he could receive better treatment under close monitoring by specialists.

After listening to the arguments, Justice Liman said he was inclined to grant the application given the urgency of the situation.

“I believe that the right to health is as important as the right to life, and so I agree that this matter can be heard by the vacation court,” Justice Liman stated.

The judge then fixed Monday, September 15, 2025, for hearing of the motion and directed the applicant’s counsel to serve all the court processes on the respondents so they would be present in court that day.

It should be recalled that the substantive terrorism charges against Kanu are still ongoing before Justice James Omotosho. The next hearing date for that case is October 10, 2025, when the court will rule on the no-case submission filed by Kanu’s lawyers.
